These Terms & Conditions (“Terms”) govern your purchase and use of products sold by Ellav8d Creations (“Ellav8d,” “we,” “our,” or “us”), including Ellav8d Return Tags and Return Stickers (collectively, the “Products”). By purchasing or using our Products or website, you agree to these Terms.

If you do not agree to these Terms, do not purchase or use the Products.

1. Product Purpose & Functionality

Ellav8d Products are tap-enabled recovery tools designed to help facilitate communication between a finder of a lost item and the item’s owner.

When tapped by a compatible smartphone, the Product triggers a pre-filled text message containing the contact information provided by the purchaser.

Ellav8d Products:

• Do not provide GPS tracking
• Do not track location
• Do not store scan data
• Do not monitor movement
• Do not guarantee item recovery

They are contact facilitation tools only.

2. Visibility of Contact Information

By purchasing and activating a Product, you acknowledge and agree that:

• The phone number or contact information you provide will become visible to any individual who taps the Product.
• Your contact information is intentionally accessible upon tap for recovery purposes.
• Ellav8d does not control who taps the Product.

Users understand that their chosen contact number is made available when the Product is tapped. The Product is intended for attachment to personal belongings for recovery purposes.

By using the Product, you voluntarily assume the risks associated with making your contact information accessible through tap activation.

For Products attached to items belonging to minors, a parent or legal guardian must provide the contact information used for recovery.

Ellav8d is not responsible for any unwanted, unsolicited, or inappropriate communications that may result from the visibility of the contact information you choose to program into the Product.

3. No Guarantee of Recovery

Ellav8d makes no guarantee, warranty, or representation that any lost item will be returned.

Recovery depends entirely on the honesty and actions of third parties. Ellav8d is not responsible for:

• Lost or stolen property
• Failure of an item to be returned
• Damage to property
• Data loss from electronic devices
• Delayed or unsuccessful communication

4. User Responsibility

You agree to:

• Provide accurate and lawful contact information
• Use the Product only for legitimate recovery purposes
•  Not program false, misleading, threatening, or unlawful content 
• Not use the Product to impersonate, harass, deceive, or defraud others

Ellav8d reserves the right to refuse service if misuse is suspected.

5. NFC & Device Compatibility

Ellav8d Products rely on Near Field Communication (NFC) technology available on compatible smartphones.

Some devices may require NFC to be enabled in system settings. Functionality may vary depending on device model, operating system, software updates, manufacturer restrictions, or user device settings.

Ellav8d does not guarantee compatibility with all devices.

6. Third-Party Communications

Ellav8d does not monitor, control, or participate in communications between individuals who interact through the Products.

Any communication initiated through a Product occurs solely between the parties involved.

Ellav8d is not responsible for the content, accuracy, conduct, or outcome of any communication between individuals who interact using the Product.

7. Prohibited Uses

Ellav8d Products may not be used for unlawful, deceptive, or harmful purposes, including but not limited to:

• Harassment
• Impersonation
• Fraud
• Misleading or malicious content
• Distribution of harmful or unlawful links

Ellav8d reserves the right to refuse service, support, or assistance if misuse of the Product is suspected.

8. Limitation of Liability

To the fullest extent permitted by law, Ellav8d Creations shall not be liable for:

• Indirect, incidental, special, or consequential damages
• Loss of property
• Loss of data
• Emotional distress
• Unauthorized or unwanted communications
• Any damages exceeding the purchase price of the Product

Your sole remedy is limited to the amount paid for the Product.

9. Assumption of Risk

You understand and agree that use of the Product involves voluntary disclosure of your chosen contact information upon tap.

You assume all risks associated with such disclosure and with interactions between individuals who may contact you through the Product.

10. Returns & Refunds

Custom-programmed Products may not be eligible for return unless defective. All returns are subject to our posted return policy.

11. Intellectual Property

All branding, logos, designs, and materials associated with Ellav8d Creations are the intellectual property of Ellav8d Creations and may not be reproduced, copied, distributed, or used without written permission.

12. Website Use

The Ellav8d website may not be used for unlawful activities, scraping, reverse engineering, or attempts to interfere with website functionality or services.

13. Modifications

Ellav8d reserves the right to modify or update these Terms at any time. Continued use of the Products or website constitutes acceptance of any updated Terms.

14. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of the State of Pennsylvania, without regard to conflict of law principles.
